1. What DesktopCat Provides

DesktopCat provides a free desktop pet application for macOS Apple Silicon and Windows x64, paid official character packs, and a custom cat character service that creates a downloadable.desktopcatpackage from photos and identity details you submit.

DesktopCat is an independent product. It is not affiliated with, endorsed by, or sponsored by OpenAI, Creem, Cloudflare, Vercel, Apple, Microsoft, or any third-party AI model provider.

2. Eligibility and Account Responsibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to buy paid products or place a custom order. You are responsible for keeping your account credentials secure and for activity under your account.

3. Your Photos, Content, and Rights

You may upload only pet photos and identity details that you have the right to use. Do not upload photos that include people, private home details, documents, addresses, license plates, or other unnecessary personal information. Crop those details out before uploading.

You keep ownership of your photos and pet identity details. By submitting them, you grant DesktopCat a limited license to store, process, transform, and review that content solely to generate concept sheets, produce your custom character package, provide support, prevent abuse, and comply with payment and legal obligations.

You are responsible for confirming that any pet name, likeness, photo, or reference material you submit does not infringe another person's copyright, trademark, publicity rights, privacy rights, or other legal rights.

4. AI Generation and Human Production

Custom orders may use third-party AI image generation services, including GPT Image 2 or comparable image models, to create three-view concept sheets from your pet photos. Production may also involve AI-assisted image or video generation tools and human review. AI output can contain errors, omissions, visual artifacts, or inaccurate markings, so you must review the concept sheet before locking it for production.

We screen generation prompts through the Creem Moderation API before they are sent to image or video generation models. Requests that are blocked, flagged, unsupported, or unavailable for moderation will not be generated.

5. Acceptable Use and Prohibited Content

You agree not to use DesktopCat to upload, request, generate, distribute, or enable:

NSFW, pornographic, erotic, nude, sexually explicit, sexually suggestive, fetish, or exploitative material.
Requests involving harmful content, harassment, hate, threats, abuse, self-harm instructions, or illegal activity.
Face-swap, deepfake, face-manipulation, impersonation, or identity-deception requests.
Images of people, minors, private homes, identity documents, addresses, or other unnecessary personal data.
Content that infringes copyright, trademark, privacy, publicity, or other rights.
Malware, spyware, unauthorized monitoring, security bypasses, or attempts to abuse the service.
Any content or conduct that violates applicable law, payment network rules, or Creem policy.

We may reject, remove, suspend, or refund orders that violate this Acceptable Use Policy. We may also refuse service where a request is ambiguous, high-risk, or outside the supported DesktopCat character workflow.

6. Paid Products, Delivery, and Access

Official character packs are digital downloads. The official character pass grants access to currently available paid official DesktopCat character packages and may include future official packs we add later.

Custom cat character orders include up to three concept sheet generation attempts, one locked concept, human production of the supported DesktopCat action states, and delivery of one downloadable.desktopcatfile. Unless otherwise stated, custom character production usually takes 3-5 business days after the concept is locked and enough reference material is available.

We do not promise unlimited revisions, a different art style, new actions beyond the supported DesktopCat character states, or frame-by-frame aesthetic changes unless we explicitly agree in writing.

7. Billing, Cancellations, and Refunds

Paid products are one-time purchases processed by Creem. DesktopCat does not store full card numbers or bank details. Pricing is shown at checkout before payment.

Official character packs are generally non-refundable after access is granted, except for duplicate charges, non-delivery, technical failure we cannot resolve, or where required by law.

For custom cat orders, you may request a full refund before locking a concept sheet. After you lock a concept and production starts, refunds are not automatic. Exceptions apply for non-delivery, duplicate charges, legal requirements, or a production failure we cannot reasonably fix.

Refund requests must be sent to chen1360245@gmail.com. Include your order number and the email used for checkout. We aim to respond within 3 business days. Approved refunds are returned through the original payment method or payment platform when possible.

8. Support and Service Availability

9. Privacy

Our data practices are described in the Privacy Policy. By using DesktopCat, you acknowledge that custom character production requires processing uploaded photos, generated concept sheets, order records, and delivery files as described there.

10. Changes to These Terms

We may update these Terms when the product, payment setup, or legal requirements change. Continued use of DesktopCat after updated Terms are posted means you accept the updated Terms.
